1- How can the refugee that is registered at Office of the United Nations High Commissioner for Refugees UNHCR get a residency in Lebanon?
You need to visit the UNHCR in order to get (a certificate of registration in the commissioner) and then take the expired previous residencies + personal identity documents+ two personal pictures authorized from the village Mukhtar+ Certificate on UN registration and then going to the Lebanese General Security position in the residence region.
3- What is the type of residency that is eligible for the refugee in case he/she got married to a Lebanese person?
Discretionary residency, with the possibility of granting the Lebanese nationality to the Syrian woman who got married to a Lebanese man.
5- Can the person who owns a property in Lebanon get a residency?
Yes, he can apply with a residency request to the General Security Position along with:
7- I'm a Syrian but my mother is Lebanese, can I get the Lebanese nationality?
Anyone that his mother is a Lebanese can’t get the nationality and also the Lebanese woman doesn’t give the nationality to her husband.
9- Can anyone that enter Lebanon pursuant to a hotel booking apply for residency?
It can happen as he must meet the required conditions for one of the residencies and he will be asked to leave the borders and then return again pursuant to the type and reason of the new residency, for example he enters and lease a property that meets the conditions and then leaves and then enter again pursuant to the lease contract which is authorized at the public security in the area of the property. He will wait for a while on the borders and he has in this period to go to the public security position in order to get the residency. ((Om some cases it's accepted to ask for residency without leaving the borders)).
11- Can the residency be move from the guarantor to the UN guarantee?
It can’t but the opposite can happen.
13- My residency got expired and they stopped me on a block, they sent me to the public security and gave me deportation, what shall I do?
There is no deportation in Lebanon for illegal Syrians since 2011 but you have to correct your legal situation by making a reconciliation and then achieve the conditions of one of the allowed residencies and apply for a residency.
15- Can the person who entered illegally to Lebanon make a reconciliation?
Yes, you can go to the public security and pay nine hundred thousand LBP and get the reconciliation.
17- How can the denial of entry put against the Syrian on the borders be elevated?
You need to check the public security and apply with a request to elevate the denial of entry and specify the reason, for example: End of the denial period so you want to remove the sign from the border records or visiting the competent side and getting a reconciliation document or paying the violation that was the reason for denial.
19- Does the refugee get removed from the UNHCR in case he traveled to Syria in a visit?
Working with the legal definition of the UNHCR for refugee as a person who escapes his country fearing for his life and the life of his family so anyone who can return to Syria means that he doesn’t fear on his life there and thus the situation of the refugee won't be applied on him and he won't need the protection of the UNHCR so he will be removed from the lists of refugees and this is what happens as the Lebanese public security shares the lists of Syrians who return to Syria with the UNHCR for this purpose.
21- How can birth be registered in Lebanon?
The birth certificate gets taken from the hospital or the certified nurse med-wife CNM and then register a birth certificate at the Mukhtar and then take it back to the doctor or the CNM to sign the birth certificate and then take it to the civil affairs department in the foreigners record along with valid residencies of the parents and the date of birth. The incident stays for 15 days and then the birth certificate gets issued, after that it gets authorized from the Lebanese ministry of foreign affairs and then from the Syrian embassy and then gets sent to the Syrian ministry of foreign affairs and then to the personal status department in Syria in order to register the incident in the family’s records.
23- Is it enough to register the baby on his time of birth with the UNHCR or there are other procedures?
Registering the birth with the UNHCR isn’t regarded a legal registration but it’s just adding the child to the family’s file in the UNHCR. The correct legal procedure as we mentioned previously is to register the baby at the Lebanese civil affairs department.
25- I got divorced with my husband so how can I register the divorce in the personal status department?
Firstly you should get a divorce decision from the competent religious court ant take it to get a divorce document issued from the Mukhtar pursuant to the divorce decision, then you register it in the civil affairs department, foreigners record, in the region of residence and then authorize it from the ministry of foreign affairs and then send it to the Syrian embassy.
27- How can I get a work residency?
Answer: You should first get a work permission from the ministry of labor pursuant to the terms and what will be explained, and then take the work permission to the public security which grants you and your family the work residency.
29- How to get work permission for workers?
They have to go to the labor office and pay nine hundred thousand LBP and specify the place of work where they want to work in as well as the type of work, the period of contract and the terms of work.
31- Is it allowed for anyone that has a residency pursuant to a lease contract or a real estate residency or under the guarantee of the UNHCR to get a work permission?
It’s not allowed for all who carry the above-mentioned residencies to work and they would be held accountable if they violate the terms of their residency (as they, as we mentioned before, should provide a pledge of not working that gets issued from the notary public) thus they might get their residency withdrawn and they will get detained and won’t be released before writing a pledge of providing necessary documents to get a work residency otherwise they will be deported.
2- How can the Syrian refugee apply for a residency if he was leasing a property?
He can go to the General Security Position in the area where the property is located with the requested documents:
4- What is the meaning of residency on a guarantor?
It means that the Syrian refugee lives in Lebanon pursuant to a residency of a Lebanese guarantor who undertakes to provide a residence for the refugee and provide a pledge of taking responsibility of him. You can apply for the General Security Position with the required documents to get this type of residency, like documents of guarantor - Leasing a property but it doesn't require to prove the financial capability.
6- Can the person who has discretionary residency work in Lebanon?
Pursuant to law, it's allowed but pursuant to the new instructions of the public security, it’s required now to provide a pledge of not being working issued from the notary public when you renew the residency.
8- Can the person who illegally entered Lebanon get a residency?
He can get the residency after making reconciliation and then meeting the conditions of one of the above-mentioned residency types.
10- What happens if someone delays in renewing the residency?
There isn’t any fine but his new residency will be counted from the expiry date of the previous residency not from the renewal date and he has to paid 300 LBP for each year of residency.
12- Is it possible in register in UNHCR?
It's not possible after 05/01/2015 to register any new refugee in the UNHCR based on a request from the Lebanese government.
14- In case your name got mistaken for a demanded person, what should you do?
You need to issue a Judicial Bulletin and check the files of chasing, reports and judgments made against the mistaken name. The procedures might be in front of the military tribunal or the criminal court, sometimes there is a contact document issued from the leadership of the army and the confusion can get solved by the competent court so get you decision and ask for a referral to be able to travel.
16- What happens if I leave Lebanon while violating the residency?
He get banned from traveling and this period varies between one year to three or five years based on whether he paid the fine or not and based on the period he stayed in Lebanon with an expired residency and whether he has any security or criminal sign.
18- Can the Syrian get a student residency?
The Syrian student who is registered in one of the authorized universities in Lebanon can get a student residency as he provides an affidavit from the university that proves his registration in it and he needs also to provide a pledge of not working from the notary public as well as pledge of accommodation and residence affidavit from the Mukhtar and pay the fees of the residency.
20- How does marriage get registered in Lebanon?
You need to go to the religious court- Shariah Court (Sunni branch)- Shariah Court (Jaafari branch)- Church according to the spiritual reference) along with individual statement for each one in the couple that is respectively authorized from the Syrian embassy and the Lebanese Ministry of foreign affairs and then you can get married. After that, the marriage contract gets registered at the Mukhtar of the town in order to issue a marriage document and then you need to go to the civil affairs department in the region in order to register the incident in the records of foreigners and at this point they will ask you to provide the valid residency documents of the couple and the date of marriage and based on that the marriage gets registered at the civil affairs department in 15 days and then you can get a marriage document that can get authorized from the Lebanese ministry of foreign affairs and then from the Syrian embassy to be able to use it to prove the incident in the personal status department in Syria.
22- My son’s birth wasn’t registered and now he is two years old and the civil affairs department in Lebanon doesn’t agree to register him, so what shall I do?
If the date of birth is more than one year ago, the birth can’t be registered without a judicial decision issued from the competent religious court in order to prove the birth incident and the parentage so you need to raise a claim of proving parentage.
24- We got marriage pursuant to a customary contract (by Sheik- a religious person) and now we have a daughter, how can we register her?
You should raise a claim in front of the religious court in order to register marriage and parentage and then pursuant to the judicial decision you can register the two incidents in the Lebanese civil affairs department in the foreigners registers pursuant to the judgment of the court.
26- How can register death?
You can get a death document from the doctor or the hospital along with burial document and then you can issue a death document from the Mukhtar pursuant to these two documents. Then you can register the incident in the civil affairs department, foreigners record, and then to the Lebanese ministry of foreign affairs and then to the Syrian Embassy.
28- What is the first grade work permission? How can I get it?
It’s the work permission that is given to the trader who register a commercial company in the companies register provided that his share from the company’s capital is more than one hundred million LBP and he should be the manager of this company. He should prove his payment for the mentioned amount of money in the company’s account at one of the banks that work in Lebanon and the company should be having a true headquarters. Then he has to complete proof documents related to the ministries of labor and social affairs and then submits the file to get consent of the labor minister and based on getting the consent of the minister he goes to the public security to issue a work residency.
30- What are the professions that are legally allowed to be worked by Syrians in Lebanon?
According to the Lebanese law it's allowed for the foreigner (in Lebanon anyone that isn’t Lebanese is regarded a foreigner) to work only in: Either a farmer or a cleaner.
