1- I got married to a Turkish man under a customary marriage contract as a second wife and I gave birth to a son but my husband refuses to register him, do I have the right to ask for alimony for my son?
Firstly regarding registering the child, the Syrian woman that got married to a Turkish man under a customary marriage contract and gave birth to a child shall have the right to register the boy under the name of the Turkish man as his father and her name as his mother - but she won’t be a wife- and if the husband refuses to register the child, she can raise a claim to establish paternity of the child and obliging the father to register him after performing DNA test. Then she of course can ask for alimony for the child who will gain the nationality of his father at the moment of registering him.
3- I left Turkey during the feast vacation decided by the Turkish government and I didn’t return in the set appointment and now they are refusing to let me enter Turkey, is there a solution?
Unfortunately, anyone that leaves Turkey and does not return during the stated legal periods loses his right in protection and also loses his “Kemlik” card especially the Turkish Government gave many periods for those who delayed in return to be able to correct their situations so anyone that couldn’t return won’t be able to enter Turkey.
5- I legally married a Turkish person and it has been 3 years now since this marriage and when I applied to get the nationality, my papers were rejected because I didn't provide a family residency, so what is the solution?
Unfortunately most of Syrians (men and women) don’t notice this issue and they get surprised with this request after the passage of the 3 years. After writing the legal official marriage contract in the marriage office in the municipality, we advise the Syrian party to change his touristic residence permit into a familial residence permit and keep renewing it annually and in this case the legally required period of three years will be counted and after that the Syrian party can submit his papers to get the Turkish nationality as they consider this period as a confirmation of familial life between wife and husband not just a customary marriage for the purpose of getting the nationality. Of course, the mutual life between husband and wife will be checked after submitting the papers and the police will visit the house of the couple and their children to check if it is true or not.
7- I want to demand reunification with my wife and children, what are the requested documents for that and where to apply with them?
At the beginning you need to know the reunification is limited to wife or husband or children below 18 years old and they have to have valid passports. Regarding the requested documents, they are (a copy of the “Kemlik” or the residency permit of the persons that demands reunification+ a residency deed from the personal status department in the region where the applicant lives+ a translated copy of the family record or a translated and authorized family statement or a translated and authorized marriage deed (if there are no children) + a statement in which the applicant of reunification clarifies his name as stated in the “Kemlik”, his place of residence, when he entered Turkey and name/ names of the persons he wants to get reunified with as written in their passports and their relation to him) and finally booking an appointment on the electronic link specified for reunification from Bab Alhawa Crossing Border exclusively and then personally submitting the documents in the specified appointment in the office of the manager of Bab Alhawa Crossing Border and finally following the page of the crossing border because it will publish the passport numbers of those who got accepted for reunification.
9- I have a “Kemlik” card from a state this is different from the one I am living in, is there a legal responsibility on me?
Yes, there is a legal responsibility that causes a financial fine and it mostly causes deportation to outside Turkey as it is not allowed to live in an address that is different from the one registered in the personal status department. Recently the Turkish authorities focused a lot on specifying addresses and updating them even if you move inside your state from one house to another, you have to update your new address thus staying outside the city where you got your “Kemlik” card will be considered a violation and deception that result in penalty and deportation.
11- I got married with a customary contract and my wife is still underage and now she is pregnant, so what is the solution?
The customary contract is not legally admitted in Turkey and it legally brings accountability and result in 6 months in prison for the husband and the father of the wife and 3 months for the religious person that wrote the contract, this is regarding the customary marriage contract. And regarding the marriage from a minor especially if she was below 17 years old, it is considered a crime of sexual assault on a minor and result in 15 years in prison for the husband and the father of the wife. So we here are facing a compound problem especially the wife is pregnant and giving birth in the hospital will lead to informing the police and then facing the penalties and if she gave birth outside the hospital, there will be a danger on the mother and you won’t be able to register the baby as there will be no birth certificate from the hospital.
13- I wrote a lease contract for one year and after few months the leaser wants to end the contract and threatened me with police if I don't do what he says, so what shall I do?
The leaser can’t evict the lessee from the property before the end of the lease contract and the police has nothing to do with such issues even if the police came and asked you to leave the place and you refused, it won’t be able to oblige you to do so and the leaser will have to go for judiciary and get a judgment with eviction. So don’t do anything and tell the leaser that you will leave his property after the end of period agreed on in the contract. We always recommend to pay the rent pursuant to receipt vouchers or a bank order in order to have a document that proves payment.
15- I’m a Syrian teacher and I’m employed in one of the Turkish schools but I was informed of getting fired, so is there a solution?
Unfortunately, the Syrian teachers were contracted by the UNICEF as volunteers not as official employees and as it is known the party that wrote the volunteering contract with you has the right to end it and release the volunteer anytime without any legal responsibility.

And it stated on imprisonment from 3 moths to one year for anyone that accepts to receive forged currency but doesn’t know that it is forged and he dealt with it after knowing that it's forged.

The Syrians can’t own properties in Turkey based on the norm of reciprocity... And buying a property by the Syrian person and registering it under a name of someone else isn’t regarded a good choice as there will be no guarantee to reclaim your ownership for the property if that person neglects it even if this was authorized at the notary public, you will claim the value of the property not the ownership of the property, so the right will be transformed from a real right into a personal right. Thus, the Syrians always go for establishing a company and register the property as one of the company’s properties and consequently all the partners of the company will be having a percentage of ownership from the property that equals his percentage in the company. This is in addition to the monthly cost of the company which reaches at least one thousand TRY which equals the rent of a house of your remained under a rent.
29- If the police station refused to regulate a complaint for me, what shall I do?
Go to the Public Prosecutions and submit your complaints in a shape of direct claim and refer in your claim that the police station refused to regulate a complaint with the incident.
2- I have a “Kemlik” and left Turkey for a compelling reason and now I returned illegally to Turkey and the “Kemlik” was canceled, so is there any solution?
The carrier of the protection card “Kemlik” doesn’t have the right to leave the Turkish lands otherwise this will be regarded as a waiver from his side of his right in protection and his Kemlik will be canceled and deleted from the system and he will be also banned from entering Turkey for a period that is between 3 to 5 years. And if he illegally enters Turkey, he won’t be able to retain his legal position unless he submits a plea of clemency to the governor of the state where he issued the void Kemlik card and if the governor accepts his request, he can reactivate the Kemlik card otherwise he will be deported outside the Turkish borders.
4- I got injured during work and I don’t have a work permission and the employer refused to fulfill his commitments towards me, so if couldn’t raise a claim, what can I do?
Even if the Syrian worker doesn’t carry a work permission and his injury was simple, the employer does respond to his basic needs, we don't recommend to raise a claim but if the injury was serious or caused permanent deformity, we recommend in this case to raise a claim in order to ask for a compensation for the work injury taking into consideration that the worker might be deported by the immigration service because he violated the protection law because of working without a work permission but in doesn’t apply this rule too often as it didn’t happen that it deported an person injured in a work injury because of working without a work permission. Here we shall point that the Turkish work law always obliges the person to work pursuant to a work permission because it provides legal protection for the worker and guarantees his rights. Unfortunately the Immigration Service still refuse to alternate the “Kemlik” with touristic residency or familial residency and we think that this is a wrong procedure that requires the affected persons to go to the judiciary in order to ask to change the “Kemlik” card with a familial residency permit relying on the official marriage document or to ask to make the date of writing the legal marriage contract as the start date of shared life and authorize this date in counting the period of three years that are necessary to ask for the nationality.
8- What is the difference between humanitarian residency and touristic residency and can the carrier of the first one travel outside Turkey?
They are equal in shape and color and both of them allow their holder to travel inside and outside Turkey without a travel permit. The touristic residency requires a medical insurance and a valid passport while the humanitarian residency doesn’t need a medical insurance nor a valid passport and the holders of any of the two residencies don’t benefit from the free medical services. However, the humanitarian residency for Syrians exclusively doesn’t permit them to travel outside Turkey (not because they are Syrians but because the humanitarian residency is given for the Syrians who have expired passports) consequently they won’t be able to travel because they don’t have a passport that is valid for travel.
10- I want to legally register my marriage contract, what are the requested documents and where to apply with them?
Firstly you have to book an appointment at the marriage office in the city’s municipality where you live and then take a referral from this office to the governmental hospital in order to get a medical report that indicates the health competency of the couple+ a copy of the “Kemlik” cards or residencies of the couple+ a bachelorette statement for each one of the couple from the Immigration Directorate and if it was hard to get, then they have to get an individual domicile number for each of them from Syria that states the familial status and authorized from the city council and the ministry of foreign affairs and then gets authorized from the Syrian consulate in Istanbul and then from the governor and then get translated and authorized from the noter+ a personal picture+ statement of residence or place of accommodation and submit all of them to the marriage office in the municipality and the marriage contract will be written in the specified appointment.
12- I entered Turkey about a month ago through the airport pursuant to a visa, so can I issue a “Kemlik” card and stay in Turkey?
Every Syrian that enters the Turkish lands by air or sea or land (from areas other than Syria) is necessarily committed to issue a touristic residency within 90 days maximum from the date of stamping his passport with the entrance stamp if he wants to stay in Turkey and he can’t issue a “Kemlik” card or a humanitarian residency... And this is for an important reason which is he came from a country where he can live safely and doesn’t need to demand protection from Turkey.
14- I got the exceptional nationality, what legal procedures should I take after that?
Firstly, you have to go to the personal status department in the region where you live to get the Turkish national identification number as well as the Turkish personal identification card and cancel the “Kemlik” or the touristic residency they you have. Secondly if you have a driving license, you will have to replace it too, you will have to hand them your license and take a temporary driving license and then you will receive your new license as a Turkish person to your address. Thirdly if you own a car, its plate will be a traveler's plate MA, so you will have to replace it with a Turkish plate as you have become a citizen. Fourthly, you can directly apply to get a passport (and it has many types and periods) and you will get it in two days to your address. Fifthly, if you are in conscription age, you will have to go to the Recruitment Department in the city you live in to know your situation in this regard.
16- Is it possible- and how - to liquidate the funds of the deceased refugee in Turkey?
The relatives of the deceased or any of his heirs can go to the magisterial court in the city where the deceased was living and died in order to get a document of settlement of a succession in order to liquidate the inheritance relying on it and giving the heirs their shares equally between males and females.
18- What is consensual divorce and what are it its terms?
Consensual divorce is an agreement between the couple to willingly get divorced and it is similar to (Abdicative divorce) in the Syrian law as the couple goes to the family court and asks to open a file of consensual divorce based on the agreement entered into between them (The agreement usually contains what they have agreed on regarding dividing money or the amount of alimony and its period and the amount of children maintenance and the person that will have custody of them and the issue of seeing the children) and mostly the judge gives a period of one month to three months for the couple to reconcile but if they insist on divorce, he shall judge with that and with what they have agreed on. This is if the marriage was officially done in Turkey but if the couple was married in Syria before coming to Turkey, they will have to provide what proves that they are married (an authorized and translated copy for the marriage deed or familial statement for them from the Immigration Service where they got the “Kemlik”+ a translated and authorized family statement from Syria in case they have kids and if the kids have “Kemlik”, they can get a statement with that from the Immigration Service).
20- Why the Syrians cannot own a property in Turkey?
The Turkish property law no. 2644 modified in 2012 with the number 6302 states on preventing Syrians from ownership in Turkey based on the norm of reciprocity although the mentioned modification stated on canceling the norm of reciprocity for Arab citizens or citizens of Islamic Republic but it kept it active for the Syrians.
22- Announcement of selling human organs and the penalty of the doer?
Article 91 from the Turkish Penal Law handled the crime of trading in human organs and it stated in one of its items on incriminating the person that announces to sell organs and imposed a penalty of one year in prison for such person. As the situation was considered as something related to physical safety and immunity. And for organs donations, it has specific regulations like making sure that there is no financial return for donation, the physical and mental health of donor, the existence of two witnesses and a specific approval for the donation process.
24- Can the Syrian person that has the Turkish nationality invite his parents and bring them to Turkey?
Yes, he can give then an invitation that get regulated at the noter and it will be attached to the copies of parents’ passports as well as a translated and authorized family statement (to prove the familial bond) and then send the invitation for them in order to attach it to the documents that they will apply with to the Turkish consulate in Beirut for example after booking an official appointment through the appointments page in order to get the Visa and the positive response to the application usually happens in a percentage of 90% but in all cases the decision of granting visa is only related to the consulate whether there is an invitation or not.
26- Can I ask for compensation for an injury or a death resulted from a road accident?
Yes, any person that got injured in a road accident or the heirs of the deceased in a road accident have the right to ask for compensation for financial and moral damage they faced as a result for the accident. And based on that, the claim must include the driver of the vehicle and the insurance company in order to guarantee to get all the compensation judged to him in case the financial capability of the driver doesn’t cover the amount of compensation.
28- Why doesn’t the Turkish state accept civil documents issued from the interim government?
The Turkish state wants to deal with official documents that have legal power and authorized from the official sides respectively. The office document is the one that gets issued from a person or a side that owns right and legal validity to issue it. And since the interim government is a political side and not a legal representative for the Syrian state, so anything that gets issued from it of documents isn’t regarded official because it doesn’t own right or legal validity to issue them.
